A Waymaker trial team represented Global Investment Ventures LLC in a breach of a guaranty agreement a defendant who had signed involving an investment in coal mining equipment.
After Ryan G. Baker and Jose Nuño conducted discovery, including party and non-party depositions, the trial team obtained summary judgment against the defendant.
The defendant argued the contract was invalid based on California’s usury laws, but in his argument, Baker established that Kentucky law controlled on that issue. The court found defendant liable for breach of contract and awarded plaintiff attorneys’ fees.
