Waymaker Obtains Complete Arbitration Victory for Real Estate Broker and Investor

Waymaker attorneys Ryan Baker and Sam Meehan were engaged to defend a real estate broker and investor against fraud and other claims. Plaintiffs sought millions of dollars in damages. Following a successful motion to compel arbitration, Waymaker filed counterclaims in arbitration for quantum meruit and unjust enrichment. Waymaker’s client had provided significant services to claimants, for which claimants had not paid.

As the case proceeded in arbitration, Waymaker aggressively pursued discovery and brought several discovery and procedural motions. Claimants repeatedly abused the discovery process and failed to comply with their discovery obligations. The arbitrator, a retired Los Angeles County Superior Court judge, repeatedly ruled in favor of Waymaker’s client.

Waymaker’s motion practice eventually culminated in terminating sanctions, an award of all attorneys’ fees, and the entry of default on the counterclaims.
