Partner Scott Malzahn persuaded a Massachusetts federal judge to dismiss Temu’s lawsuit accusing their clients Intellectual Property pioneer Jeffrey Gluck and his law firm of lying to secure settlements for artists that Mr. Gluck represented.
U.S. District Judge Richard Stearns agreed with Waymaker’s argument that Temu had failed to allege facts to plausibly support its claim that Mr. Gluck or his firm made any false statements. Temu had sought to rescind settlements and funds it paid to resolve trademark infringement and copyright claims that Gluck brought on behalf of two clients related to products offered on Temu’s website.
Temu should never have tried to intimidate Jeff and his law firm with this meritless suit, but Temu got what it deserved. We appreciate the judge doing the right thing here and dismissing Temu’s ridiculous complaint so swiftly.
