A Waymaker trial team achieved a precedent-setting victory for its client Avraham Eisenberg, who the U.S. Attorney’s Office for the Southern District of New York charged with manipulating the Mango Markets cryptocurrency platform and stealing over $100 million.
On Friday, May 23, the trial court agreed with Waymaker’s arguments and acquitted Mr. Eisenberg of wire fraud and vacated his conviction on the other two counts, which were for commodities fraud and market manipulation. In doing so, the court set precedent for “code is law” type of defenses and on the proper venue for such trials.
After the motion was announced, Eisenberg’s lead counsel Brian Klein said, “From the beginning, we said this case was fatally flawed. We are very pleased for Avi that the Judge granted our motion and dismissed the case.”
This win came a year after a nine-day trial in April 2024 where a jury convicted Mr. Eisenberg of commodities fraud, commodities manipulation, and wire fraud. However, the Waymaker trial team and co-counsel moved for relief under Federal Rule of Criminal Procedure 29, arguing that the evidence at trial was insufficient to sustain these convictions.
The Waymaker trial team included Ashley Martabano and Riley Smith. Sam Talkin and Noam Greenspan of Talkin, Muccigrosso & Roberts LLP acted as co-counsel on the case.
